How Employers Use Nondisclosure Agreements

How Employers Use Nondisclosure AgreementsHow Employers Use Nondisclosure AgreementsA nondisclosure agreement is a written legal contract and is usuallybetween an employer and an employee. The contract lays out binding terms and conditions that prohibit the employee from disclosing confidential and proprietary company information. For the agreement to be legally binding, the employee must receive something in return for signing itemployment in this case. Nondisclosure agreements are also known as nondisclosure, (NDA), confidential disclosure agreements, secrecy agreements, proprietary information agreements, andconfidentiality agreements. An NDA is in effect for the duration of an employees employment and for a period of time following employment termination. To be enforceable, a nondisclosure agreement must be protecting information that is both confidential and valuable. Other Instances When Nondisclosure Agreements Are Used In other circumstances where an employer is intereste d in keeping confidential and proprietary company information private, a nondisclosure agreement may be instituted. Using an NDA under some of these circumstances requires a leap of faith by the employer who may not know all the individuals who are involved in the conversation. However, by using a bindinglegal document, the employer would have some recourse if confidential or proprietary company information welches shared. The occasions for which an employer will want to use a nondisclosure agreement include NDAs for Management and Senior Level Job Interviews Any interviews where confidential companyinformation is discussed with the candidate as it is nearly impossible to hire a senior staff person without discussing highly confidential information. Without the discussion, the employer and candidate would not be able to identify whether the candidate fits the job. Consultant, Contractor, and Vendor Nondisclosure and any products that result from the contractual work performe d forthe company. Along with any other proprietary information sharing to determine whether the vendor has the capability and capacity to produce the necessary product. Situations Involving Stock or Company Purchase These include any interaction during which confidential information is shared. During due diligence, any person who must review confidential company information is required to sign a nondisclosure agreement. It includes accountants, company owners, product review senior employees, and so forth. EmployerBenefits Employers benefit from nondisclosure agreements because they keep these parties from sharing with competitors any proprietary knowledge, trade secrets, client or product information, strategic plans, or other information that is confidential and proprietary to the company. Nondisclosure agreements state that the signer cannot disclose or in any way profit fromconfidential company information supplied to them. Nondisclosure agreements frequently claim compa ny ownership of anything that is developed, written, produced, or invented during or as a result of employment, contracts, services, or interviewing if it is in any way related to the scope of the companys business. A nondisclosure agreement should offer a clause that allows an employer to sign off on or give permission to the signer to use company proprietary information. It allows employees some latitude to participate in activities such as starting a business or becoming a supplier to their former employer.

Why peoples fitness posts make us feel bad about ourselves

Why peoples fitness posts make us feel bad about ourselvesWhy peoples fitness posts make us feel bad about ourselvesWhen you scroll through your Instagram and see friends and coworkers posting about finishing that marathon or meeting that weight loss goal, their happiness about their accomplishment can come at a cost to your mental wellbeing. This is the dark side of fitspo (fitness inspiration) that a new study published in the journal Health Communication discovered.Researchers Tricia Burke andStephen Rains found that the more exercise-related posts you see in your feed, the more self-conscious and concerned about your weight you can become, which can result in an unhealthy body image. Although people might have positive intentions with regard to posting about exercise online (e.g., promoting accountability and motivation), these posts can result in observers body dissatisfaction, the study concluded.Exercise posts increase our weight concernHow badly you felt about someones gym se lfie depended on how you viewed the people in your social media feed. When researchers recruited 232 people to count the number of exercise-related posts they saw on their favorite social media platform, they found that people who felt they were similar to those frequent exercise posters were especially prone to feeling self-conscious.Similarity heightens social comparison, so if the person posting about exercise is someone whos in your age group, has a similar build or a similar background, you might think thats a pretty good reference, and that might spark in you even greater weight concern,Rains, one of the authors, of the study, said. But a marathon selfie is not always going to send you in a downward spiral about yourself. The researchers found that for people who make upward comparisons, or people who saw the exercisers as oben liegend to them, they developed more positive exercise attitudes. If my awesome friend could wake up early to run, why cant I? becomes your motivating m antra to hold yourself accountable. With upward social comparisons, you tend to compare yourself to those you perceive as superior to you, Burke said. So, for example, if youre in a classroom, youd compare yourself to the smartest kid in class. In terms of exercise, if a person is posting a lot about exercise, they must be really fit, so youre using that as a motivator. We measure ourselves by other peoples success. Sometimes, it can be motivating to observe your buddys fitness journey from afar. But sometimes, it may be better to opt out and unfollow.

Employees Found to Expect Flexible Scheduling but Doubt its Value

Employees Found to Expect Flexible Scheduling but Doubt its Value Employees Found to Expect Flexible Scheduling but Doubt its Value Employees were found to believe that the prime motivator for the shift welches based in business concerns rather than benefiting employees. Over half of respondents said the most common reason for the popularity of flexible work scheduling was efficiency and productivity while 12 percent said greater flexibility was a result of a desire to help employees better manage their workload and hours worked. This perception appears to have greatly contributed to employees ranking flexible working as on the sixth most important benefit offered to employees.Respondents ranked several business benefits based on importance 25 days of vacation (40 percent) Company pension plan (29 percent) Annual bonus plan (24 percent) Smartphones (18 percent) Insurance (16 percent) and Flexible working hours (12 percent).A gender divide was identified that showed women were more likely than men to believe flexible working schedules was a vital business benefit, measured at 16 percent and 9 percent, respectively.Stephen Menko, Director of Ortus UK said, These findings suggest HR professionals have their work cut out for them in convincing staff of the relative merits of flexible working. The business case is obvious as it allows for efficiency savings on office costs and greater output. However, the benefit to the individual of a better work-life balance and less time and money spent commuting are, perhaps surprisingly, ranked low, and maybe HR needs to convey this cost-effective benefit in a more compelling way. Widespread flexible working could be a seismic shift in the way work is conducted and it is that rare beast a change that benefits everyone. Staff members just need to be convinced of this point, or at least have it raised on their radar as a benefit they can request.

Hired! Building for Success

Hired Building for SuccessHired Building for SuccessBlueprint for job-search success in constructionThe challenge is to find your niche, said David Rosenof, chief operating officer and VP of Hunter Construction in Pompano Beach, Fla. Three years ago, if you could fog a mirror, you could get a construction contract. Now its a little bit harder.Despite the odds, Hunter is rising to the challenge under Rosenofs leadership as a successful construction firm in a cooling economic climate. Only a year ago, though, Rosenofs future seemed less askoranversd. Florida contractors started falling by the wayside as the national economy softened and many of the larger, more dynamic construction companies began the process of rightsizing to cut staff. The economic downturn was not schwefelyperit on Rosenof as he began to weigh his options in December 2007. His position as the owners representative on a project overseeing the construction of two 26-story towers of luxury condominiums had a non-renewab le end date. Rosenof decided he needed to ensure he would not join other construction industry veterans faced with limited job options in the wake of ever-increasing layoffs.Rosenof said his job search required him to understand what was slowing his industrys market and not to let fear distract him. The thing that worked for me was patience, he said. There is a rule of thumb that for every $10,000 that you make, it takes a month to get a job. And that was about right for me. And so having that thought in my mind, I didnt panic. I just made sure I had plenty of time to find what I have found.A random zugnglich search led Rosenof to Ladders.com, where he joined UpLadder. I think I just took a chance, he recalled. That is the best way to put it. I was debating between all those free job-search sites and I figured I would just give it a shot.Rosenof admitted he was initially resistant to implementing some of the advice in his resume critique. It went against everything I thought a res ume was supposed to be, but I trusted my critiquer and did it. At least half of the recruiters I talked to said it was one of the better resumes that they had seen. So whatever she did worked.Opportunity in new nichesRosenof said farewell to project-based work and stepped into the senior management role of COO for Hunter Construction, a comparatively small firm that (despite his added responsibilities) allowed him some new freedoms. Rosenof was now able to relish the little $3 million or $5 million project Get it done, get it in, get it out. And to be able to delegate a lot more tasks than I had before. The market for construction was leise there to be tapped but perhaps more successfully on a smaller scale. In these budget-strapped times, inexpensive fast-food enterprises are booming while splashy, exclusive restaurants are feeling the pinch. By the same token, new construction on larger expansive projects was drying up, while niche areas in the industry continued to thrive. I thi nk that is part of the angst in Florida there arent the $50 million to $100 million jobs lined up, one after another. Hunter Construction is a very small company and very adaptable to a lot of things, and there are still people doing $1 million additions, or half-a-million-dollar additions. If you do them right and you do them quickly, and do a good job, you can be pretty profitable. While many frustrated job seekers are jumping ship to other fields, the New Jersey-born exec knows that he has found his calling. My first job in college was as a carpenter in Ohio, Rosenof recalled. My father was a truck driver in New York City. He was a blue-collar guy, but he made sure that all my brothers and sisters and I received an education. Construction proved to be a field where Rosenof said I could successfully combine the blue-collar background and work ethic while at the same time using my brain. Now I run construction instead of working it.A degree in construction management helped set him on the right path early. But when he was swinging a hammer at the age of 18, could he have predicted hed be a COO someday? I cant tell you that I knew that, he laughed. But now, having had to transform his skill set within an ever-changing industry pummeled by recent economic storms, David Rosenof is sure he has found his niche.
